Purpose of Committee

The Licensing Committee has the full delegated authority to exercise the council’s powers:

(1)       To hear cases where the person in control of a registered house in multiple occupation ceases to be a fit and proper person.

(2)       To grant or refuse applications for house-to-house collections.

(3)       To grant applications for street collections.

(4)       All matters concerning Certificates of Suitability under the provisions of the Licensing Act 1964 (as amended).

(5)       To determine all applications for the grant, renewal and transfer of entertainment licences under Section 1 of and Schedule 1 to the Local Government (Miscellaneous Provisions) Act 1982 (as amended).

(6)       To determine the grant, refusal, renewal and transfer of sports entertainment licences under Section 1 of Schedule 1 to the Local Government (Miscellaneous Provisions) Act 1982 (as amended).

(7)       To determine applications for the grant and transfer of track betting licences pursuant to the provisions of the Betting, Gaming and Lotteries Act 1963 (as amended).

(8)       To consider and determine applications made for amusement with prizes machines under Section 34 of the Gaming Act 1968 (as amended).

(9)       All functions including applications arising under the following statutes:-

Betting, Gaming and Lotteries Act 1963 (as amended)

Gaming Act 1968 (as amended)

Gambling Act 2005 (as amended)

Licensing Act 2003 (in accordance with the Licensing Policy and the table appended to it)

Local Government (Miscellaneous Provisions) Acts 1976 and 1982 (as amended)

Lotteries and Amusements Act 1976 (as amended)

Sunday Entertainments Act 1932 as amended by the Licensing Act 2003

(10)     To consider and determine all applications for grant, transfer and renewal of licences relating to premises or the use thereof where:

(i) there are objections from the Head of Environment and Street Scene and/or the fire safety and/or the Police; or

(ii) there is a history of relevant complaints concerning the premises to which the application refers; or

(iii) in the case of new applications, when referred by the ward councillors; or

(iv) where approval is outside the delegated authority of the Head of Environment and Street Scene.

(11)     To consider and determine the proposed revocation of a licence when the Head of Environment and Street Scene recommends.

Note 1:  Any of the above powers may be delegated to a sub-committee or to an appropriate officer of the council.

Note 2:  To consider and determine any application for an amendment or deletion of any condition attaching to a licence where (11)(i) or (11)(ii) above apply and the amendment or deletion is material.
